Mr. Kim understands the key issues that arise in construction and design disputes, including quantum, extra work, change orders, delay, and liquidated damages.  He also has substantial experience with disputes involving power plants and solar power in the context of construction and other contracts.  Cases he has handled as arbitrator or counsel include:  

  • One of three ICC arbitrators in dispute arising from default on $90 million in financing for construction of innovative solar power plant

  • Sole ICDR arbitrator in dispute arising from contract to design smartphone-based laptop

  • Sole AAA arbitrator in dispute about referral fees for home solar installations

  • Counsel to Korean construction company in ICC arbitration arising from contract to build cement factor in Saudi Arabia, involving claims for quantum and premature mobilization  

  • Counsel for EPC contractor in KCAB arbitration arising from construction of $400 million combined cycle power plant

  • Counsel in ICC arbitration in Paris arising from contract to build specialized rail cars

  • Counsel in AAA arbitration involving political risk insurance for Columbian power plant
